Your Account with ComixCentral

You’ll need to create an account with ComixCentral to use some of our Services:

  1. You must be 18 or older to use our Services. Otherwise, you may only use our Services under the supervision of a parent or legal guardian.
  2. Provide accurate information about yourself. It’s not OK to use false information or impersonate another person or company through your account.
  3. You are responsible for your account. You’re solely responsible for any activity on your account. If you’re sharing an account with other people, then the person whose billing information is on the account will ultimately be responsible for all activity.
  4. Protect your password. As we mentioned above, you’re solely responsible for any activity on your account, so it’s important to keep your account password secure.
  5. These Terms do not create any agency, partnership, joint venture, employment or franchisee relationship between you and ComixCentral.

Your User Name and Password

To access certain areas of our website, we may require a user name and password. You are responsible for maintaining the confidentiality of your user name and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your user name or password.

Your Content

Content that you post using our Services is your content (“Your Content”). ComixCentral makes no claim to. This includes, but not limited to, Comicbooks, graphic novels, custom art, merchandise, site mail, forum posts, blogs, reviews, photos and videos and anything you post using our Services (like usernames, shop names, profile pictures, listing photos, listing descriptions, reviews, comments, videos, etc.).

  1. Responsibility for Your Content. You understand that you are solely responsible for Your Content. You represent that you have all necessary rights to Your Content and that you’re not infringing or violating any third party’s rights by posting it.
  2. Permission to Use Your Content. By posting Your Content through our Services, you grant ComixCentral a license to use it. We don’t claim any ownership to Your Content, but we have your permission to use it to help ComixCentral function and grow. We will not infringe any rights you have in Your Content and we can help promote Your Content.
  3. Rights You Grant ComixCentral. By posting Your Content, you grant ComixCentral a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content to provide the Services and to promote ComixCentral, your ComixShop, or the Services in general, in any formats and through any channels, including across any ComixCentral Services or third-party website or advertising medium.

This grant is necessary for us to keep ComixCentral operational. Examples: if you upload a photo of a Comicbook on your ComixShop, first, we have permission to display it to buyers, and second, we can resize it so it looks good to a buyer using our mobile app; if you post a description in English, we can translate it into French so a buyer in Paris can learn the story behind your item; and if you post a photo of your latest project, we can feature it on our homepage, social media accounts and newsletter.

(CXC Note) This is good for you and for ComixCentral. To be clear, we do not own your content, we are merely using your content to promote and operate ComixCentral.

  1. Reporting Unauthorised Content. CoimxCentral has great respect for intellectual property rights, and is committed to following appropriate legal procedures to remove infringing content from the Services. If content that you own or have rights to has been posted to the Services without your permission and you want it removed, please contact us immediately. If Your Content infringes another person’s intellectual property, we will remove it if we receive proper notice. We’ll notify you if that happens.

Your Use of Our Services

License to Use Our Services. We grant you a limited, non-exclusive, non-transferable and revocable license to use our Services—subject to the Terms and the following restrictions in particular:

  1. You agree that you will not violate any laws in connection with your use of the Services. This includes any local, state, federal and international laws that may apply to you. For example, it’s your responsibility to obtain any permits or licenses that your shop requires; you may not sell anything that violates any laws; and don’t commit fraud, theft or any other crimes against ComixCentral another ComixCentral user or a third party.
  2. You are responsible for paying all fees that you owe to ComixCentral. You are also solely responsible for collecting and/or paying any applicable taxes for any purchases or sales you make through our Services.
  3. You agree not to interfere with or try to disrupt our Services, for example by distributing a virus or other harmful computer code.

Termination

Termination By You. You may terminate your account with ComixCentral at any time for any reason. Please contact our support team for account termination [email protected]

Termination By ComixCentral. We may terminate or suspend your account (and any related accounts) and your access to the Services at any time, for any reason, and without advance notice. If we do so, it’s important to understand that you don’t have a contractual or legal right to continue to use our Services, for example, to sell or buy on our website or mobile apps.ComixCentral may refuse service to anyone, at any time, for any reason.

  • If you or ComixCentral terminate your account, you may lose any information associated with your account, including Your Content.
  • We May Discontinue the Services. ComixCentral reserves the right to change, suspend or discontinue any of the Services at any time, for any reason. We will not be liable to you for the effect that any changes to the Services may have on you, including your income or your ability to generate revenue through the Services.
  • Survival. The Terms will remain in effect even after your access to the Service is terminated, or your use of the Service ends.

Communicating

SiteMail

You may use the ComixCentral internal SiteMail system to have conversations with other members of ComixCentral and the ComixCentral employees.

Site Mail may not be used for the following activities:

  1. Sending unsolicited advertising or promotions, requests for donations or spam;
  2. Harassing or abusing another member;
  3. Contacting someone after they have explicitly asked you not to; or
  4. Interfering with a transaction or the business of another member.

Interference

Interference is strictly prohibited on ComixCentral. Interference occurs when a member intentionally interferes with another member’s shop in order to drive away their business.

Examples of interference include:

  1. Contacting another member via SiteMail to warn them away from a particular member, shop or item;
  2. Posting in public areas to demonstrate or discuss a dispute with another member;
  3. Purchasing from a seller for the sole purpose of leaving a negative review;

Harassment

Any use of SiteMail to harass other members is strictly prohibited. Similarly, SiteMail may not be used to support or glorify hatred toward, or otherwise demean people based upon: race, ethnicity, religion, gender, gender identity, disability or sexual orientation. If you receive a communication that violates this policy, please inform us immediately.

Emails

You may receive a buyer’s email address or other information as a result of entering into a transaction with that buyer. This information may only be used for ComixCentral-related communications or for ComixCentral-facilitated transactions. You may not use this information for unsolicited commercial messages or unauthorised transactions. Without the buyer’s explicit consent, you may not add any ComixCentral member to your email or physical mailing list or store or misuse any payment information.

Disputes

ComixCentral urges Vendors, Buyers and other Members to cooperate with each other to resolve disputes before contacting ComixCentral for assistance.

Because ComixCentral is the agent of Vendor and is not the agent of Buyer for any purpose, ComixCentral will act as either party’s agent in connection with resolving any disputes between participants related to or arising out of any transaction.

Creating and Uploading Content

As a member of ComixCentral, you have the opportunity to create and upload a variety of content, including, but not limited to, usernames, site mail, forum posts, blogs, reviews, photos and videos. In order to keep our community safe and respectful, you agree that you will not upload content that is:

  1. Abusive, threatening, defamatory or harassing;
  2. Overly obscene or vulgar;
  3. In violation of someone else’s privacy or intellectual property rights; or
  4. False, deceptive or misleading.

OPENING MY COMIXSHOP

Setting up a ComixShop on ComixCentral is free. Each product listed is priced by the ComixShop owner.

VENDOR PAYOUTS

When one of your products is purchased your commissions will be deposited into your account. Track your earnings in your Account. Payouts occur on or about the first of each month. Vendor accounts must have accumulated a minimum of $10 in order for cash out to occur.

EXTORTION

Extortion is strictly prohibited on ComixCentral. Any attempt to manipulate reviews through threats, intimidation, or bribery is considered extortion and will not be tolerated on ComixCentral. Extortion includes when a vendor offers a buyer additional goods, services, or compensation in exchange for a positive review.

SHILLING

Shilling (the fraudulent inflation of a shop’s reputation by use of an alternate account, ie: leaving fraudulent reviews) will not be tolerated on ComixCentral. It is considered to be a deceptive business practice by the US Federal Trade Commission. Reviews must reflect the honest, unbiased opinions, findings, beliefs or experience of the buyer.

Termination

Termination By You. You may terminate your account with ComixCentral at any time for any reason. Please contact our support team for account termination [email protected]

Termination By ComixCentral. We may terminate or suspend your account (and any related accounts) and your access to the Services at any time, for any reason, and without advance notice. If we do so, it’s important to understand that you don’t have a contractual or legal right to continue to use our Services, for example, to sell or buy on our website or mobile apps. Violations of the Vendor terms

Buyer Policy

Buyer Policy

ComixCentral is a community and marketplace where you can purchase indie(creator owned) comicbooks, art and other merchandise directly from Vendors. Please read on to find out what is expected of you, as a buyer.

This policy is a part of our Terms of Use. By shopping on ComixCentral, you’re agreeing to this policy and our Terms of Use.


ComixCentral’s Limitations as a Venue

ComixCentral provides a venue for buyers to enter into transactions with indie comic creators from around the world.

By shopping on ComixCentral, you understand that:

  1. You must be 18 years or older to purchase from this site.
  2. You are not buying directly from ComixCentral, but from one of the indie Comic creators selling on ComixCentral;
  3. ComixCentral does not pre-screen sellers and therefore does not guarantee or endorse any items sold on ComixCentral; or any content posted by sellers (such as photographs or language used in listings or shop policies)
  4. As a member of the community, you may report any content or Vendor not complying with ComixCentral’s Terms and Conditions.

Communicating with Other ComixCentral Members

SiteMail

Purchasing products on ComixCentral

When you buy from a Comixshop on ComixCentral, you’re directly supporting an independent business, each with its unique listings. By making a purchase from a seller on ComixCentral, you agree that you:

  1. Have read the item description before making a purchase;
  2. Have submitted appropriate payment for item(s) purchased; and
  3. Have provided accurate shipping information to the seller. (When required)
  4. Are 18 years or older.

Leaving a Review

Reviews are a great way to learn about a seller’s items and reputation, help good sellers build a strong reputation, or help warn other buyers about a poor experience.

You can leave a review, including a one to five star rating. By leaving a review, you acknowledge that:

  1. Your review and profile information will be publicly displayed on the seller’s listing and review pages.

Reviews may not:

  1. Contain private information;
  2. Contain obscene, racist or harassing language or imagery;
  3. Contain prohibited medical drug claims;
  4. Contain advertising or spam;
  5. Be about things outside the seller’s control, such as a shipping carrier, ComixCentral or a third party; or
  6. Undermine the integrity of the Reviews system.

Extortion

Hiring an Artist for Commission

At this time, Artist commission transactions must take place completely off site and should be handled solely between the artist (seller) and the member requesting the commission (buyer).

ComixCentral only provides prospective buyers with a list of members who have offered their services as artists. ComixCentral does not vet this list in anyway, therefore it is up to the buyer to research the artist, making themselves familiar with the artist’s work. ComixCentral is not liable for any broken agreements or damages.

If artist and buyer come to an agreement and a piece of art is commissioned, it is the sole responsibility of the seller to:

  • Come to an agreement on the price of commissioned piece
  • collect deposit (if requested)
  • complete commission
  • collect payment (as per agreement)
  • package and ship commission (as per agreement)
  • handle any returns or refunds (as per agreement)

In order to create a record of the transaction, we recommend communicating via either CXC site mail or your own email. We would also encourage artists and buyers to draft a contract.

LICENSE AND SITE ACCESS

Once ComixCentral receives a claim of intellectual property infringement, the material will be suspended from ComixCentral.com immediately. In the case that no counter claim is issued, the material stated in the infringement claim will be permanently removed from the ComixCentral database, and the member will receive notice of the removal.

Submitting a counter notice to a claim of infringement against you

Use this information to counter a copyright infringement notice submitted against you.

If you have a good faith belief that you received a copyright infringement notice under the Digital Millennium Copyright Act. (“DMCA”) as a result of a mistake or misidentification, you may consider submitting a counter notice.

ComixCentral only accepts counter notices from the intellectual property owner or an authorised representative. (In other words: if you don’t own the IP or have been authorised to act on behalf of the owner, you may not submit a counter notice)

The intellectual property owner or the authorised representative must email [email protected] directly to submit a counter notice to the claim of infringement against you.

The communication must clearly identify the relevant material (such as by providing the relevant username, shop name, blog post, image url and/or product listing URLs) etc.

Your counter notice must be sent in an email to [email protected] and contain the following:

  1. Your signature - signatures may be provided electronically by typing your name
  2. Identification of the material that has been removed or to which access has been disabled - please provide the ComixCentral URL to each item before it was removed or disabled
  3. A statement made under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material
  4. Your name, address, telephone number and email address, and a statement that you consent to the jurisdiction of the Federal Court for the judicial district in which you are located.

Once ComixCentral confirms that the counter notice includes all of the information required by the DMCA, Comixcentral will email both parties: the member submitting the counter notice and the party who submitted the initial infringement claim. ComixCentral will provide a copy of the counter notice to the party who submitted the initial infringement claim, who may use the information to obtain a court order to restrain you from reactivating the material.

Counter Notification

If ComixCental receives a DMCA counter notification, the removed material may be replaced or access to it may be restored 10 business days after receipt of the counter notice, unless the copyright owner files an action seeking a court order against the allegedly infringing party and informs ComixCentral of this action. ComixCentral sends a copy of the counter notice to the original complaining party.

Pursuing Legal Action
